Australian Court Fines Sportschamp For Featuring Illegal Gambling Advertisement

Spotschamp, an Australian wagering company has been convicted and penalized for featuring an illegal gambling advertisement.

Following the investigation from the Liquor and Gaming NSW, Downing Centre local court slapped a penalty of $2,500 on Sportschamps. Besides, they also mandated that the brand pays a sum of $3,250 towards the legal costs incurred on the investigation and other procedures as they were found guilty on breach of NSW gambling laws.

The illegal gambling advertisement was published on the brand’s website on 5 July 2018.

It read: “Matched first time deposit bonus up to $50 – Deposit for the first time and we’ll match your deposit with Bonus Cash, up to $50. Keep the winnings from Bonus Cas (sic)”. There was a button close by that said: “Sign up for free.”

As per the NSW Betting and Racing Act, it is illegal to publish “a gambling advertisement that offers any inducement to participate, or frequently participate, in any gambling activity (including an inducement to open a betting account).”

Chief Magistrate Graeme Henson, also considered the argument given by Sportschamp that no customer got into an engagement with the brand with that advertisement as no one signed up for the offer.

Sean Goodchild, Director of Compliance Operations, the Liquor & Gaming NSW, held that the advertisement in question was a clear violation of the NSW gambling advertising laws.

“Advertising gambling inducements is unlawful in NSW, and operators who flout or try to get around these restrictions are acting against industry and community interests and increasing risks of gambling harms,” he said.
